Who/how/ what legislation is enacted in health care sector?

What principles should be followed in law-making process? What is the nature of legislation in health care sector? Is it acceptable that significant amount of regulation was moved under the exclusive rule-making of Ministry of Health? How does rule-making process look like? Who makes the rules? Are all relevant subjects (patients, insurance companies, health care providers, pharmaceutical companies) engaged in rule making process? Who's interest should prevail? What are the advantages and disadvantages of the current situation? Is it safe to apply unclear rules?

 

Principle of autonomy in physician-patient relation

What is the principle of patient autonomy? Is the patient's autonomy absolute? How to balance informational asymmetry between physian and patient?To what extent is a patient entitled to determine conditions under which health care is provided to him? Is a health care provider/physian autonomous while providing health care ?Should be the patient's will respected even if it leads to death ? Is an informed consent an unreachable goal or condition sine qua non for medical practice?

Who pays for health care (is solidarity limited)?

 

What principles did influence current model of health care financing? Are these principles applied in medical practice? Are health care providers/patients/insurance companies aware of them? What are the advantages and the disadvantages of current model of financing?Is there any simple solution to problems? Could we take inspiration from abroad? It is necessary to apply solidarity model and where are its limits? Is it acceptable to make a profit from distribution of public funds?

 

New - patient friendly principles

 

Orientation to health not long term illness. To cure or to heal? Who is interested in treatment of illness except from patient? Who does make a profit? What principles are health-oriented? How could a patient influence health care principles? Is there any place for "health defenders" in the health care system? Should it be more stress put on patients and patients'organizations opinions? How to achieve that goal?

Quality vs. scarcity of resources
(right to free health care)?

 

On what principles distribution of services and resources should be based? How health care should be distributed ? Has everyone right to everything? How to make decision in extreme situations? Should we pay for treatment of terminally ill patients? How does current pharmaceutical policy look like? Is cheaper always better?

 

Who is liable and for what?

 

Is health care provider liable for providing incomplete information to patient? Could health care provider be exempted from liability by providng extensive information on the risks of procedure? What is the relevance of informed consent when ascribing liability? Is it fair to claim damages along with non pecuniary damages? Should we hold patient liable, too?

A patient= a client/a customer?

Principle of property protection in medical practice. Is a health care provider obliged to help regardless of his loss? Is it legitimate to make a profit out of health care services?  What is the nature of patient-provider legal relation? What are principles is it built upon? Is patient a client/  a customer? Is it even possible for providers to make a profit?

 

Is the Convention on the Rights of Persons With Disabilities a useful tool or just a formal declaration?

 

Slovakia is a signatory to the Convention- do we realize implications of our international obligation?  What is the impact of the Convention on life of persons with disabilities? Which areas are impacted the most? What are the short-term/long-term goals of the Convention implementation in Slovakia? Are the ones concerned (persons with disabilities) informed about the Convention?
